The Attorney General’s Office is responsible for the State’s case when a criminal prosecution is appealed in Maryland, acting as the attorney for the local (county) State’s Attorney as well as “the State”. It is highly unusual but they can override this and remain involved when an appeals case is returned to the lower courts, as they did in 2015/2016 when Adnan’s case was remanded to the Circuit Court resulting in the second PCR hearing. In the first PCR hearing
the Baltimore State’s Attorney Office (successfully) handled the case for the prosecution themselves.
